Trademark Litigation

A trademark is not merely a name or a logo - it is the accumulated goodwill of decades, the shorthand customers trust. When a competitor or a counterfeiter trades on that mark, the harm is not abstract; it compounds daily, eroding the distinction its owner built. Trademark disputes take many forms: infringement, dilution, counterfeiting, and false designation of origin and unfair competition under the Lanham Act. The enforcement landscape has grown faster and more punishing. The Supreme Court has narrowed once-reliable defenses - constraining parody claims after Jack Daniel's, clarifying the extraterritorial reach of the Lanham Act, and sharpening the standards for the disgorgement of profits. Online counterfeiting has industrialized, multiplying infringers across marketplaces overnight. Brewer steps in where the stakes are exceptionally high and the outcome will define a brand's future.

Founded in 1984 and operating from Dallas and New York, Brewer represents entrepreneurs, Fortune 500 corporations, and major nonprofits in the disputes that matter most to them. Our trial lawyers pursue the full range of remedies the law allows: injunctions that halt infringement, disgorgement of a wrongdoer's profits, damages that account for the harm inflicted, and the destruction of counterfeit goods. We litigate in the federal courts and before the Trademark Trial and Appeal Board, matching the forum to the objective. Our advocacy is principled and relentless - measured in judgment, unwavering in execution.

A brand fight is also a reputation fight, and Brewer answers on both fronts. Our trial lawyers are supported by in-house business consulting, investigative, and public relations professionals who work as one integrated team. The investigative arm tracks infringers across borders and marketplaces, turning counterfeiters' anonymity against them, while the communications professionals protect the brand's standing as the case proceeds. This is full-spectrum advocacy, and it is cutting-edge by design.

Featured Intellectual Property Litigation Victory

Brewer's flagship intellectual property trial victory came in the defense of FLIR Systems. In Raytheon Company v. FLIR Systems, the Firm defended FLIR's subsidiary Indigo Systems against Raytheon's claims that it had misappropriated 31 alleged trade secrets in infrared camera technology, with more than $650 million in damages sought. After a 17-day trial, the jury ruled unanimously for FLIR - finding no misappropriation and concluding that 27 of the 31 alleged secrets were not trade secrets at all - and the verdict was affirmed on appeal.

Trademark litigation is one dimension of the Firm's broader Commercial Litigation practice.
