Statement from William A. Brewer III on the Supreme Court Birthright Citizenship Decision

The Court's decision to affirm birthright citizenship is a wise challenge to those attempting to rewrite the Fourteenth Amendment. Fortunately, Chief Justice John Roberts made clear for the majority, the text and history of the Constitution are unequivocal: “A child born on American soil and subject to American law was made an American citizen.” Accordingly, five Justices agree that federal and state actors lack the authority to transform that absolute guarantee into a conditional privilege.

When the government relies on manufactured theories to bypass bedrock liberties, the judiciary must intervene. This ruling strips away political posturing and demands strict adherence to the law, rejecting what Justice Ketanji Brown Jackson's concurrence aptly described as an odious attempt to "make bloodline the marker of birthright."

Our experience in constitutional advocacy has us gratified for what the Court did today. We commend the Court for protecting the integrity of the Constitution, affirming that citizenship remains “the right to have rights,” and rejecting overreaching attempts to dilute liberties.
