Asset Portfolio

A distressed portfolio is often where recovery is won or lost at scale. One misjudged collateral position is a bad file; the same misjudgment repeated across hundreds of loans can be the difference between par and cents on the dollar. Security interests assumed to be perfected may not be. Value may bleed away while a sale runs on a calendar someone else controls. And money a holder counted as recovered can be pulled back years later by an avoidance claim nobody priced. Brewer, Attorneys & Counselors is retained when a book of that size is contested and the adversary across the table is prepared to try it.

Liquidating trustees, secured lenders, official committees, distressed funds and buyers of distressed assets bring the Firm portfolios whose value is already under attack. What they want is typically stated plainly: the maximum the book will yield, a sale process whose result will hold, the defeat of claims that would strip value from an estate, and recovery from the officers and directors whose conduct produced the loss. Brewer prosecutes and defends those matters in the bankruptcy courts, in the district courts, and on appeal, frequently on parallel tracks and under exigent circumstances. The Firm builds such matters as a case to be tried.

The Firm’s courtroom advocates work alongside in-house litigation consultants, who model recovery loan by loan, test appraisals and going-concern assumptions, and trace what left the balance sheet before a filing. In-house communications professionals carry the public weight of a contested recovery. It is an arrangement that lets Brewer litigate a portfolio the way it was assembled - all of it, at once.

Featured Asset Portfolio Victory

Brewer represented the liquidating trustee of Lomas Financial Corporation and Lomas Mortgage USA, an enterprise that held roughly $6 billion in assets before what the Firm describes as one of the largest financial collapses of the 1990s. A second Chapter 11 was filed in 1995. On behalf of the trust, the Firm pursued breach of fiduciary duty claims against former officers and directors and obtained a multi-million dollar settlement.

The Firm's asset portfolio work is part of its broader Bankruptcy Litigation practice.
